Why We Must Impeach Gov Fubara- Rivers Assembly Members

The members of the Rivers State House of Assembly on Thursday renewed their earlier move to impeach the state’s governor, Mr. Siminalayi Fubara.

The lawmakers successfully served impeachment notice on the governor citing a litany of constitutional breaches by the embattled governor.

Explaining the reason behind the move, the Majority Leader of the Assembly, Honb. Major Jack, said the decision to remove the governor was rooted Mr. Fubara and his deputy’s continuous violation of the peace agreement brokered by President Bola Tinubu. Following the expiration of the six-month state of emergency imposed on the state in March 2025.

The Majority Leader reiterated that Governor Fubara and his deputy had repeatedly disregarded the resolutions reached during reconciliation efforts aimed at restoring stability in the state.

“The governor and his deputy have continued to act in a manner that undermines democratic principles and accountability,” Hon. Jack said.

 

Allegations Against Governor Fubara

In the impeachment notice signed by about 20 members, the lawmakers listed the allegations against the governor as follows:

 

1. Reckless and unconstitutional expenditure of public funds,

 

2. Unconstitutional misappropriation of public funds,

 

3. Hindering the Rivers State House of Assembly from performing their constitutional duties,

 

4.  illegal appointments of persons without allowing for screening by the house of Assembly as provided by the constitution,

5.  Seizure of salaries and funds meant for Assembly members,

 

6. Seizure of salaries of the clerk of the Rivers State House of Assembly, Emeka Amadi,

 

7. Refusal to implement provisions of the constitution on financial autonomy of the Legislature and the Judiciary and

 

8. Withholding of funds meant for the running of the Rivers State House of Assembly Service commission and hindering it’s activities

Confirming the service of the impeachment notice, the House in a statement shared on its social media handle late Thursday stated that,  “The impeachment notice has been successfully served on the Governor of Rivers State, Siminalayi Fubara.”

 

Speaker Martin Amaewhule had earlier in written the embattled governor intimating him of the impeachment notice while citing the sections of the constitution the governor was accused of breaching.

The Speakers letter reads in part:

“RE: NOTICE OF ALLEGATIONS OF GROSS MISCONDUCT BROUGHT PURSUANT TO SECTION 188 OF THE CONSTITUTION OF THE FEDERAL REPUBLIC OF NIGERIA, 1999 (AS AMENDED), FORWARDING OF COPY OF NOTICE OF ALLEGATIONS OF GROSS MISCONDUCT, cited Gross misconduct of the executive arm of the government.

“I received a copy of the Notice of allegations of gross misconduct dated 5th January 2026 and brought against you by twenty-six (26) members of the Rivers State House of Assembly- a number that represents over two-third (2/3) of the membership of the Rivers State House of Assembly.

“Pursuant to Section 188 (1) and (2) of the Constitution of the Federal Republic of Nigeria, 1999 (as amended), I hereby forward to you – Sir Siminalayi Fubara GSSRS, a copy of the said Notice of Allegation of Gross Misconduct received by me on the 8th day of January 2026. A copy is attached.

“You are requested to reply to the allegations made against you in the said Notice of Allegations of Gross Misconduct accordingly. In doing this, your attention is drawn to the provisions of Section 188 of the Constitution of the Federal Republic of Nigeria, 1999 (as amended).
