Uncertainty Looms, NASS Await Tinubu’s Official Gazette of Rivers’ Emergency Declaration  

 

 

 

The senate and the house of representatives are yet to receive the official proclamation of the state of emergency in Rivers state.

 

Following the suspension of the Rivers states Governor and his deputy the president by law is mandated to send a correspondent to bind his declaration to the national assembly, The president according to the 1999 Constitution must Immediately transmit to National Assembly after the issuance, the President must transmit copies of the Official Gazette containing the proclamation to the President of the Senate and the Speaker of the House of Representatives.

The interpretation of this if the National Assembly is in session, within two days after the publication of the proclamation and if the National Assembly is not in session, within ten days after the publication of the proclamation.

The president bind by the Constitution must transmit the Official Gazette containing the proclamation to the President within two days.

 

The national assembly lawmakers sits only on Tuesdays, Wednesdays and Thursdays except for emergency situations may seat outside these days.

 

The president may be breaching the Constitutional provision on the matter if by tomorrow the national assembly could not consider and effect the proclamation

 

“National Assembly is required to convene and consider the proclamation. For the proclamation to remain effective, it must be approved by a resolution supported by a two-thirds majority of all members of each House”

 

The questions many are asking is “does the national assembly have the numbers to effect the proclamation of state of Emergency in Rivers state
