The Distance Between Anyawu and Prison is Now Half km if He Parades as Secretary- Ikenga Opposition Lawmakers Coalition Spokesman
The High Court Enugu Division has restricted the sacked National Secretary of the Peoples Democratic Party (PDP), Samuel Anyanwu from parading himself as the party’s scribe, failure of which he would land himself in prison.
The order contained in judgement delivered by the presiding Judge C.O. Ajah, PhD ordered that: “unless you (Anyanwu) obey the directions contained in this Order, you will be guilty of Contempt of Court and will be liable to be committed to prison.”
The judgement sighted by journalists is sequel to the case filed by Emmanuel Aniagu (plaintiff) with Peoples Democratic Party (PDP), PDP Acting National Chairman, Iliya Umar Damagun, Anyanwu and PDP National Vice Chairman, Southeast, Ali Odefa as defendants.
The Court ordered that: “the 3rd Defendant(Anyanwu) was elected National Secretary of the 1st Defendant (PDP) in 2021 and has remained so till date, and as National Secretary, he is by the provisions of the 1st Defendant’s Constitution as well as the Electoral Guidelines for Primary Elections of the 1st defendant made by the National Executive Committee of the 1st Defendant by dint of the provisions of S.31(20)(j) and 50(1) of the Constitution of 1st Defendant, 2017 and that he:
“(a) Draws up the list of members of the Gubernatorial Screening Committee for each of the six geo-political zones of the 1st Defendant in the country when decision on it is taken by the National Executive Committee.
“(b) Writes and signs, or causes to be written and signed letters to the individual members appointing them members of the Gubernatorial Screening Committee of the six geo-political zones of the party in the country from the list already prepared and signed by him.
“(c) Draws up the list of members of the Gubernatorial Screening Appeal Panel to handle Appeals from Gubernatorial Aspirants of the party in all States of the Federation when decision on the list taken by the National Executive Committee of the 1st Defendant.
“(d) Writes and signs or causes to be written and signed letters to individuals appointing them as such members of the Gubernatorial Screening Appeal Panel of the village.
“(e) Draws up the list of members of the State Gubernatorial Electoral Committee for each of the 36 States of the 1st Defendant in the federation when the decision of the said list is taken by the National Executive Committee of the 1st Defendant.
“(f) Writes and signs or causes to be written and signed letters to the individual members of the State Gubernatorial Electoral Committee appointing them as such members.
“(g) Writes and signs or causes to be written and signed letters to the individual members of the Gubernatorial Electoral Appeal _ Panel appointing them as such members when decision on the membership is made by the National Executive Committee of the 1st Defendant.
“2. That the 3rd Defendant has a lot of input to make in taking and implementing decisions on who will be adjudged eligible to contest the gubernatorial primaries, and who shall be enthroned as the gubernatorial standard bearer of the 1st Defendant in all the 36 States of the Federation.
“3. That the 3rd Defendant was elected in April, 2023 as the Gubernatorial Candidate of the 1st Defendant for the Imo State Governorship election billed for November, 2023 whilst the 3rd Defendant still doubles as the National Secretary of the 1st
Defendant. 4. That by occupying the two positions, the 3 Defendant made —himself a judge in his own cause.
“7. That the 3rd Defendant is hereby restrained forthwith from further parading himself as the National Secretary of the 1st Defendant having relinquished the said position by conduct.
“8.That the 2nd Defendant is hereby ordered to recognize in all situations, for all purposes, and in every manner necessary, including swearing in, Hon. S. K. E. Udeh Okoye (the person recommended by the South East Zonal Executive Committee of the 1st Defendant) as the National Secretary of the 1st Defendant, to enable the said Hon. S. K. E. Udeh Okoye to serve out the time left in the tenure for which the 3rd Defendant was elected as National Secretary in 2021.”
