The Court of Appeal Abuja division is expected to hear the matter between the Chairman of the Peoples Democratic Party (PDP), Imo State and the party on the issue of the factional national convention of the party that was held in Ibadan, Oyo State.
In the suit marked, CA/ABJ/CV/1613/2025 the Governor Makinde led faction of the PDP is challenging the judgement of the Federal High Court Abuja which stopped the factional national convention of the PDP that took place on November 16 2025 in Ibadan, the Oyo State capital.

Justice James Kolawole Omotosho of the Federal High Court Abuja had on October 31, 2025 delivered judgement on the suit and restrained the Independent National Electoral Commission (INEC) from accepting the outcome of the convention on the grounds that the party had failed to comply with extant electoral laws as well as the constitution of the PDP.
The defendants in the suit include, the Independent National Electoral Commission (INEC), PDP, Samuel Anyanwu, National Secretary of the party, Umar Bature, National Organizing Secretary of the party, National Working Committee (NWC) and National Executive Committee (NEC) of the party, Ambassador Umar Iliya Damagum, Ali Odefa, and Emmanuel Ogidi.
Hon. Austin Nwachukwu and his colleague from Abia State had approached the court to stop the convention and compel the the PDP to fulfil its own constitutional provision on the conduct of state congresses before the conduct of its national convention.
